Communication Is Your Right (CIYR) is dedicated to the proposition that the United Nations should take Article 19 of the Universal Declaration of Human Rights seriously by protecting the right to share ideas through media. The ways we hope to accomplish this is by providing users the ability to sign petitions supporting this petition, and providing a forum for user-submitted media (the “Services”).

To provide the Services, we have to set out some ground rules in this document (the “Terms”).  By accessing, using, or contributing to the Services, and in consideration for the Services we provide to you, you agree to abide by the Terms of a legal agreement between you and CIYR. “CIYR” refers to the owners of the CIYR website and anyone who provides the Services of the CIYR website.

Your Acceptance
By using the CIYR website, (“Website”) you are agreeing to the following terms and conditions.  If you do not agree with a provision here or in our Privacy Policy please DO NOT use the Website.
CIYR may change the Terms from time to time at CIYR’s sole discretion. Your continued use of this website following the posting of such changes will constitute your assent to all such changes. Please periodically visit this section of the Website to review the current version of the Terms.
To utilize the Services, or certain portions thereof, you may be required to input personal information. You represent and warrant that all information provided by you to CIYR is current, accurate, and complete.

Code of Conduct
CIYR reserves the right to pre-screen or review contributed content. Additionally, CIYR reserves the right to delete material and terminate accounts at its discretion with or without notice to the user.  Users shall adhere to the Code of Conduct to avoid such termination.
Users shall not contribute content containing or involving material that is obscene, defamatory, libelous, unlawful, harassing, abusive, threatening, harmful, vulgar, constitutes an illegal threat, violates export control laws, hate propaganda, fraudulent material or fraudulent activity, invasive of privacy or publicity rights, profane, indecent or otherwise objectionable material of any kind or nature specifically including, but not limited to, posting a photograph of another person without their consent and posting an illegal or unauthorized copy of another person’s work.
Additionally, CIYR users are prohibited from submitting material that encourages conduct that could constitute a criminal offense, gives rise to civil liability, or holds CIYR or their employees, volunteers, or agents up to public scorn, ridicule, or defamation.

You understand that the information made available by CIYR is the product of a community effort between the operators of CIYR and users. It does not necessarily represent the views of CIYR. CIYR assumes no responsibility for the accuracy, suitability, or completeness of any content provided.

Linking
Please note that the Website may contain links to other third party websites that are not owned or controlled by CIYR.  CIYR has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, CIYR will not and cannot censor or edit the content of any third-party site.  By using the Website, you expressly relieve Communication Is Your Right from any and all liability arising from your use of any third-party website.

Commenting Guidelines
CIYR hopes to bring a diverse range of perspectives and voices into the site by displaying user submissions, but we will decline to publish certain types of unacceptable content, and we reserve the right to remove it if we find it on this site.
Unacceptable content includes, but is not limited to, the following:

• Statements that are intended as a personal attack or are abusive, harassing, or threatening
• Defamatory or knowingly false statements
• Information of a private or personal nature that does not have news value
• Irrelevant statements or SPAM
• Materials that violate the copyright, trademark, or trade secret rights of others that are not otherwise authorized by law, such as fair use

CIYR will determine what is “unacceptable content” on a case-by-case basis.  We reserve the right to change these standards at any time. We also reserve the right to remove links to unacceptable off-site content at any time.

CIYR License
By contributing content using these Services or our third party accounts (such as our Youtube and Vimeo accounts), you are granting CIYR a non-exclusive, royalty-free, perpetual, and worldwide license to use your content in connection with the operation of the Services, including, without limitation, the license rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your content, and/or to incorporate it into a collective work.

Indemnities
CIYR requires you indemnify them against any liability resulting from your use of their services.  CIYR retains the right to employ CIYR’s own counsel.  You remain solely responsible for CIYR’s defense and must obtain CIYR’s written consent to a settlement.  You agree to notify CIYR of a pending suit claiming you have violated a third party’s intellectual property rights.  CIYR requires that you confirm your indemnification in case of a lawsuit; failure to do so may be considered a breach of your terms of service.

Trademark and Copyright Infringement Policy
You agree not to infringe copyright, trademark, patent, trade secret, or other proprietary rights.  By posting any content, you represent and warrant that you have all right, title, and interest to such posted content, including but not limited to any consent, authorization, release, clearance or license from any third party (such as, but not limited to, any release related to rights of privacy or publicity) necessary for you to provide, post, upload, input or submit the content, and that posting such content does not violate or constitute the infringement of any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other intellectual property right recognized by any applicable jurisdiction of any person or entity, or otherwise constitute the breach of any agreement with any other person or entity. You further represent and warrant that you are who you say you are, that you have not submitted fictitious, false or inaccurate information about yourself, and that all information contained in the posted content is true and your own work or work you are authorized to submit, and that the posted content does not contain any threatening, harassing, libelous, false, defamatory, offensive, obscene, or pornographic, material, or other material that would violate any other applicable law or regulation. You represent and warrant that the content you supply does not violate the Terms.  CIYR will take down material in response to a notice of copyright infringement.

Governing Law
This agreement is governed by California law and any action arising from the agreement will be brought in San Diego County.

No Waiver of Terms
CIYR’s failure to exercise or enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in that or any other instance.

Entire Agreement
The Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of the Terms will continue in full force and effect.
